Betfair won on the grounds of restriction of interstate trade.
The W.A. Govt. claimed the Betfair gave zero back to the W.A. race industry.
The beak claimed that was a different conversation which had nothing to do with the legality of restriction of trade between states otherwise there would be a state tax for goods to be brought accross the boarder which was ruled against the Australian constitution which was contested some years ago with the NSW state taxation on cigaretts in a case by a Cabranatta tobacconist some years ago for bringing stock accross the QLD boarder so as to avoid the NSW tax on baccy.
The constitution states that it is illegal for the states to collect such taxes.
They ruled if such taxes had to be collected, it must be done by the Federal Govt. on the condition that all states had the same tax & the same rate.
