tried the link but doesn't bring anything up unfortunaly doesn't bring much up..

Even worse, I'm in Victoria :-(

I told them ages ago I was booking a flight to come up and see them, but they convinced me not to, and then the delays went on from there..

In the next week, I'm going to Asic/Accc them...

If you end up in the cafe, and you happen to talk to them, tell them Renzo says hi :-)

EDITED: AVOID UNPLEASANTNESS.

You will need to file a small claim at the Southport Magistrates court. You will need to prosecute the entity that you entered into contract with. If it is a Pty Ltd ensure to include (join) the Directors (do a company search).

File your claim and let them file a defence. If they do not file a defence you can apply for default judgment.

After winning your case (or getting default judgment) you still have to get the money - you have only got a judgment. You will need to apply for a warrant (from the Court) to bring the defendants back to Court and give an account of assets and liabilites - subject to this the court will order them to pay according to their means.

Hi and thanks..

Only 1 prob.

I don't remember signing a contract.
They can't supply me with one, and I asked their lawyer last week to get me a copy of one, and ALL they have is a copy of my finance agreement (to get a credit card for the loan)..

Could this be in my advantage?

I have reviewed all of your posts. Clarify a number of points for me please.

What exactly did you buy? ie software, computer etc etc
Did you receive what you paid for? Think before you answer the question.
How did you pay? ie credit card, cash - you mention earlier about re-financing the mortgage.
Did you sign a contract to purchase, and were you provided a copy?
What have you done with whatever you purchased?

In the meantime take bacos advice and discover who exactly it is that you need to prosecute, locate their whereabouts residentially, discover what assets they have recorded in their name, consider taking action.

With any luck most of this post will be left in tack.
