When a company is insolvent they should cease trading immediately that they become aware that they cannot pay their commitments. They cease or call in administrators. If it can be shown that they have continued to trade past this date (take subscriptions etc) then the directors position changes from being personally protected by companies laws, to a position of being personally liable for additional debts. This should make them personally liable in returning these subscriptions. The lists etc and programs and like are company property and the liquidator can overturn any dispersement of company assets within six months of becoming insolvent. Phoenix Rising
